  • The owner of a building was sued by the tenant for breach of the lease; the owner sought coverage under his liability insurance company. Coverage was denied because there was no claim that anyone suffered any bodily injury or property damage. When the insured threatened to sue for bad faith we filed a civil action for declaratory relief and obtained a Declaratory Judgment in favor of the insurer.
  • A helicopter crashed, and the operator's insurer defended the passenger's lawsuits. On behalf of this insurer we sued another insurance company which also covered the accident and had refused to provide coverage. Following trial, we recovered half the defense costs and attorney fees incurred in defending the passenger lawsuits. 
  • A flight instructor, not approved by the owner's insurance company to give flight instruction, rented an airplane to give night instruction to her student.  During the return flight the next morning the aircraft lost power and crashed, resulting in serious injuries to the student and flight instructor.  The flight instructor claimed that at the time of the accident she was not providing instruction because she was simply returning the aircraft following the night instruction.  Following trial, the Court disregarded the instructor's post accident testimony and on the basis of all evidence ruled that the instructor was giving instruction at the time of the accident.  The Court issued a Declaratory Judgment establishing that the insurer had no duty to defend or indemnify anyone for any claim arising out of the accident.
  • An aircraft was damaged by fire and a dispute arose concerning the amounts payable for the repairs. When the insured threatened to sue for bad faith, we commenced an action for declaratory relief to establish that the dispute had to be resolved through an out-of-court process specified in the contract. The dispute was then resolved promptly through an abbreviated hearing before the Court based on documents submitted by the parties, with no oral testimony.
