  • The founder of an Illinois company selling a specialty chemical to the oil refineries allowed his son to take over the business on a long-term contract. Business revenues dropped dramatically and the father was sued when he attempted to take back the business. After more than seven months of protracted litigation, our firm was substituted in as counsel for the father's company, and obtained a Partial Summary Judgment establishing that the son's company had materially breached the contract. The entire claim was then resolved without having to go to trial..
  • A US-based manufacturer supplied component parts to Airbus for the Airbus A340 airplanes. One of those airplanes, owned by an international airline, was damaged on the ground, and the airline sued Airbus and the parts manufacturer in France. The contract of sale between Airbus and the airline called for disputes to be resolved in a New York Court under New York law, which did not allow any recovery for the damages being claimed. On behalf of the parts manufacturer, we commenced a separate action in New York, asking the New York Court to issue a Declaratory Judgment establishing that the parts manufacturer also had the right to enforce this contract and that neither the parts manufacturer nor Airbus had any liability to the airline. The New York Court agreed, and issued the Judgment as requested. Thereafter, the French Court issued a decree that the New York Judgment was to be recognized and enforced in France.
  • A helicopter sales contract provided a liability waiver in favor of the American distributor but not the French manufacturer. The helicopter was destroyed as a result of a defective component part. While the American distributor was held not liable as a matter of law, the French manufacturer was held subject to liability for breach of warranty and the case was resolved by settlement.
